Взаємовплив громадянського суспільства та сил оборони України: правовий та економічний виміри

Abstract

Стаття присвячена проблематиці конституційно-правового та економічного вимірів взаємовпливу громадянського суспільства та сил оборони України. При цьому, оскільки саме громадянське суспільство України виявилося тим чинником, що на перших порах протистояло російській агресії, а згодом істотно вплинуло на процеси формування та функціонування сил оборони України, що не могло не мати зворотного характеру, дослідження подібного взаємовпливу має актуальний характер. Отже, метою цього дослідження є конституційно-правовий та економічний виміри взаємовпливу громадянського суспільства та сил оборони України. Реалізація зазначеної мети потребує виконання низки наукових завдань. У статті обґрунтовано, що правові засади формування та функціонування громадянського суспільства сформульовані у вітчизняному законодавстві. З’ясовано, що громадянське суспільство України є важливим елементом вітчизняного соціуму, оскільки бере на себе частку регуляторної ролі суспільства і при цьому взаємодіє із державою в якості рівноправного суб’єкта. Доведено, що вплив громадянського суспільства на сили оборони України є вкрай важливим, адже стосується як його безпосередньо прямої участі в обороні України в лавах, зокрема, ЗСУ, так і опосередкованої – через допомогу силам оборони. Стаття містить висновок про те, що вплив сили оборони України на громадянське суспільство матиме значний характер під час повоєнної ситуації в Україні. Наголошується, що під час широкомасштабного вторгнення 2022 р. на перших порах особливо відзначилися сили територіальної оборони, оскільки на деяких ділянках російсько-українського кордону стали тією силою, яка призупинила рух російського агресора. При цьому, визначається, що одним з напрямів, яким українське громадянське суспільство відзначилося під час опору, стали волонтери, значна частина який були дрібними та середніми підприємцями. З’ясовано, що вплив сил оборони України на громадянське суспільство нині здійснюється самим фактом існування та діяльності сил оборони, які захищають Україну та українське громадянське суспільство, а в майбутньому подальша технологізація сил оборони сприятиме розвитку громадянського сектора економіки, а демобілізовані ветерани можуть долучитися до політичної діяльності в лавах політичних партій. Практична цінність роботи полягає у необхідності початку вироблення стратегії розвитку громадянського суспільства та сил оборони України не лише в реаліях сьогодення, а й на майбутнє.

The article is devoted to the problems of the constitutional, legal and economic dimensions of the mutual influence of civil society and the defense forces of Ukraine. At the same time, since the civil society of Ukraine turned out to be the factor that initially resisted Russian aggression, and later significantly influenced the processes of formation and functioning of the defense forces of Ukraine, which could not but have a reverse nature, the study of such mutual influence is of an urgent nature. Therefore, the purpose of this study is the constitutional, legal and economic dimensions of the mutual influence of civil society and the defense forces of Ukraine. The implementation of the specified goal requires the performance of a number of scientific tasks. The article substantiates that the legal principles of the formation and functioning of civil society are formulated in domestic legislation. It was found that the civil society of Ukraine is an important element of the national society, as it assumes a share of the regulatory role of society and at the same time interacts with the state as an equal subject. It has been proven that the influence of civil society on the defense forces of Ukraine is extremely important, because it concerns both its direct participation in the defense of Ukraine in the ranks, in particular, the Armed Forces, and indirect - through assistance to the defense forces. The article concludes that the influence of the defense forces of Ukraine on civil society will be significant during the post-war situation in Ukraine. It is emphasized that during the large-scale invasion of 2022, the Territorial Defense Forces were especially distinguished at the beginning, as they became the force that stopped the movement of the Russian aggressor in some areas of the Russian-Ukrainian border. At the same time, it is determined that one of the directions in which Ukrainian civil society distinguished itself during the resistance were volunteers, a large part of which were small and medium-sized entrepreneurs. It has been found that the influence of the defense forces of Ukraine on civil society is currently carried out by the very fact of the existence and activity of the defense forces, which protect Ukraine and Ukrainian civil society, and in the future further technologicalization of the defense forces will contribute to the development of the civil sector of the economy, and demobilized veterans can join the political activity in the ranks of political parties. The practical value of the work lies in the need to start developing a strategy for the development of civil society and defense forces of Ukraine not only in the realities of today, but also for the future.
