Міжнародно-правові стандарти у сфері захисту прав осіб з психічними та поведінковими розладами

Abstract

За останній час, загострення появи розладу психічного здоров’я, невпинно зростає. Адже, каталізатором може бути будь яка подія в світі або особистий тригер внутрішнього потрясіння особи, що спричиняє додатковий тиск на психічне здоров’я людей, особливо серед молоді та тих, хто вже має психічні розлади. Люди, які мають захворювання психічного та ментального здоров’я, створюють найуразливішу категорію населення, яка через стигматизацію соціуму, не здатна придатним чином, подбати про свої права. В більшості випадків соціум, негативно налаштований на дану категорію населення, внаслідок чого, особи що мають розлади психіки та поведінки страждають через дискримінацію в свою сторону. У зв’язку з цим, постає питання про дієвий механізм захисту, який в свою чергу буде забезпечувати права осіб з розладами психіки. Мета роботи полягала в дослідженні міжнародно-правових стандартів, стосовно захисту прав осіб з психічними розладами, а також порівняльна характеристика правового регулювання захисту прав осіб з психічними розладами в Україні. Об’єктом дослідження є механізм міжнародно-правового захисту осіб з психічними розладами. Предметом дослідження є положення стосовно захисту прав осіб з психічними розладами, щодо реалізації їх прав і свобод в рамках міжнародних організацій та застосування міжнародно-правових стандартів в Україні. Основними результатами роботи стало дослідження реалізації міжнародного механізму захисту прав осіб з психічними розладами, зокрема увага була присвячена роботі Ради Європи та ООН; характеристика захисту прав осіб з психічними розладами в розрізі міжнародних стандартів та національного законодавства.

Relevance of the research topic. Recently, the aggravation of the appearance of a mental health disorder has been steadily increasing. After all, the catalyst can be any event in the world or a personal trigger of internal shock of the person, which causes additional pressure on the mental health of people, especially among young people and those who already have mental disorders. People with mental and mental health diseases create the most vulnerable category of the population, which, due to the stigmatization of society, is not able to properly take care of their rights. In most cases, a society negatively inclined to this category of the population, as a result, persons with mental and behavioral disorders suffer from discrimination in their direction. In this regard, the question arises of an effective protection mechanism, which in turn will ensure the rights of persons with mental disorders. The purpose of the work was to study the standards of the Council of Europe regarding the protection of the rights of persons with mental disorders, as well as a comparative description of the legal regulation of the protection of the rights of persons with mental disorders in Ukraine. The object of the study is the mechanism of international legal protection of persons with mental disorders, on the example of the legal heritage of the Council of Europe and the United Nations. The subject of the study is the provision on the protection of the rights of persons with mental disorders, on the implementation of their rights and freedoms within international organizations and the application of international legal standards in Ukraine. The main results of the work were the study of the implementation of the international mechanism for the protection of the rights of persons with mental disorders, in particular, attention was devoted to the work of the Council of Europe; characteristic of the protection of the rights of persons with mental disorders in the context of European standards and national legislation.
