Abstract

Поводження з ув’язненими: міжнародні стандарти та проблеми застосування в Україні Актуальність теми дослідження обумовлена необхідністю вдосконалення системи поводження з ув’язненими в Україні відповідно до міжнародних стандартів. У процесі інтеграції України в європейське та світове співтовариство забезпечення прав людини, зокрема прав ув’язнених, є важливим аспектом, що потребує відповідності міжнародним нормам та стандартам. Мета роботи полягає у вивченні сутності та змісту міжнародних стандартів поводження з ув’язненими, аналізі їх застосування в Україні та розробці рекомендацій щодо вдосконалення національного законодавства і практики в цій сфері. Об’єктом дослідження є правовідносини у сфері поводження з ув’язненими в Україні. Предметом дослідження виступають норми міжнародного та національного права у сфері поводження з ув’язненими та практика їх застосування. Основні результати роботи включають аналіз ключових міжнародних документів, що регулюють права ув’язнених, таких як Конвенція проти катувань та інші жорстокі, нелюдські або такі, що принижують гідність, види поводження і покарання, Мінімальні стандартні правила поводження з ув’язненими (Правила Нельсона Мандели) та інші. Дослідження також містить оцінку стану застосування цих стандартів в Україні, визначає основні проблеми та недоліки національної системи поводження з ув’язненими. Зокрема, в роботі розглядаються питання, пов’язані з умовами тримання під вартою, забезпеченням медичної допомоги, запобіганням катуванням та іншим формам жорстокого поводження, а також доступом до правової допомоги. На основі проведеного аналізу були розроблені конкретні рекомендації щодо вдосконалення законодавства та практики поводження з ув’язненими в Україні, спрямовані на приведення їх у відповідність до міжнародних стандартів. Робота робить висновок, що інтеграція міжнародних стандартів у національну систему поводження з ув’язненими є необхідною умовою для підвищення рівня захисту прав людини в Україні. Запропоновані зміни та рекомендації мають сприяти покращенню умов тримання під вартою, забезпеченню належного медичного обслуговування, захисту від жорстокого поводження та наданню ефективної правової допомоги ув’язненим, що в кінцевому підсумку сприятиме загальному вдосконаленню пенітенціарної системи в Україні.

Treatment of Prisoners: International Standards and Problems of Application in Ukraine The relevance of the research topic is driven by the necessity to improve the system of handling prisoners in Ukraine in accordance with international standards. In the process of Ukraine’s integration into the European and global community, ensuring human rights, including the rights of prisoners, is a crucial aspect that requires compliance with international norms and standards. The work aims to find out the essence and content of international standards for the treatment of prisoners, analyze their application in Ukraine, and develop recommendations for improving national legislation and practices in this field. The research object is the legal relationships in the field of prisoner treatment in Ukraine. The subject of the study is the norms of international and national law in the field of prisoner treatment and the practice of their application. The main results of the work are an analysis of key international documents regulating the rights of prisoners, such as the Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, the Standard Minimum Rules for the Treatment of Prisoners (Nelson Mandela Rules), among others. The research assesses the state of implementation of these standards in Ukraine, identifies the main problems and shortcomings of the national system of prisoner treatment. In particular, the work addresses issues related to conditions of detention, provision of medical care, prevention of torture and other forms of ill-treatment, as well as access to legal assistance. Based on the analysis conducted, specific recommendations were developed to improve legislation and practices in the treatment of prisoners in Ukraine, aimed at aligning them with international standards. The work concludes that integrating international standards into the national system of prisoner treatment is a necessary condition for enhancing the level of human rights protection in Ukraine. The proposed changes and recommendations are intended to improve conditions of detention, ensure adequate medical care, protect against ill-treatment, and provide effective legal assistance to prisoners, ultimately contributing to the overall improvement of the penitentiary system in Ukraine.
