Розширення повноважень поліцейських на період введення в Україні воєнного стану: проблеми забезпечення захисту прав і свобод людини

Abstract

Актуальність теми дослідження пов’язана з надзвичайно важливою складовою функціонування будь-яких правоохоронних органів – дотриманням та захистом прав і свобод людини. Національна поліція України є центральним органом виконавчої влади, який служить суспільству шляхом забезпечення охорони прав і свобод людини, протидії злочинності, підтримання публічної безпеки і порядку. В умовах введення в Україні воєнного стану повноваження працівників поліції були дещо розширені, а конституційні права людини суттєво обмежені. Саме тому постає проблема висвітлення проблеми забезпечення, дотримання та захисту прав людини в діяльності Національної поліції України в умовах воєнного стану. В роботі проведено аналіз норм як міжнародного, так і національного права, а також судової практики з питань захисту прав людини в сфері діяльності правоохоронних органів, а також узагальнено існуючі проблеми дотримання, забезпечення та захисту прав людини поліцейськими під час дії воєнного стану, та запропоновано перспективи їх вирішення в українській державі. Метою роботи є проведення порівняльно-правового дослідження розширення повноважень поліцейських на період введення в Україні воєнного стану та проблем забезпечення захисту прав і свобод людини за українським законодавством та міжнародним, визначення спільних та відмінних рис, розробка пропозицій по удосконаленню національного законодавства. Основними результатами роботи стало узагальнення існуючих міжнародних та європейських стандартів щодо забезпечення та дотримання прав людини в діяльності поліції, виявлення особливостей захисту прав людини правоохоронними органами, а також дослідження національного механізму забезпечення та захисту прав людини в рамках розширення повноважень поліцейських в умовах введення правового режиму воєнного стану.

The relevance of the research topic is related to an extremely important component of the functioning of any law enforcement agencies - the observance and protection of human rights and freedoms. The National Police of Ukraine is the central body of the executive power, which serves society by ensuring the protection of human rights and freedoms, countering crime, and maintaining public safety and order. Under the conditions of the introduction of martial law in Ukraine, the powers of police officers were somewhat expanded, and constitutional human rights were significantly limited. That is why there is a problem of highlighting the problem of ensuring, observing and protecting human rights in the activities of the National Police of Ukraine under martial law. The work analyses the norms of both international and national law, as well as judicial practice on the protection of human rights in the field of law enforcement agencies, as well as summarizes the existing problems of observing, ensuring and protecting human rights by the police during martial law, and offers prospects their solution in the Ukrainian state. The purpose of the work is to conduct a comparative legal study of the expansion of police powers during the period of the introduction of martial law in Ukraine and the problems of ensuring the protection of human rights and freedoms under Ukrainian and international legislation, identifying common and distinctive features, developing proposals for improving national legislation. The main results of the work were the generalization of the existing international and European standards regarding the provision and observance of human rights in police activities, the identification of the peculiarities of the protection of human rights by law enforcement agencies, as well as the study of the national mechanism for the provision and protection of human rights within the framework of expanding the powers of police officers in the conditions of the introduction of a legal regime of martial law.
