Забезпечення права на свободу віросповідання: національні та міжнародні стандарти

Abstract

Актуальність теми дослідження полягає в проблемі захисту свободи совісті та віросповідання в сучасному міжнародно правовому аспекті, оскільки вона стосується кожної людини. Загалом можна виділити кілька причин: по-перше, права та основоположні свободи людини – це основна цінність й пріоритет сучасного світу; по-друге, захист релігійних прав та свобод має значення не лише на індивідуальному рівні, але й у контексті міжнародних відносин, демократії та толерантності суспільства. А досліджуючи міжнародні та національні механізми захисту можна визначити ефективність їх застосування, і власне їх вплив на реальні ситуації. Мета роботи полягає в здійсненні комплексного аналізу і дослідження міжнародних та національних механізмів забезпечення свободи совісті та віросповідання, виявленні основних викликів і проблем у цій сфері, а також розробці рекомендацій щодо вдосконалення правового регулювання для ефективного захисту цього фундаментального права. Об’єктом дослідження є відносини, що виникають у сфері захисту права на свободу совісті та віросповідання на національному, європейському та універсальному рівні. Предметом дослідження виступають міжнародні та національні механізми захисту свободи совісті та віросповідання. Основними результатами роботи стало дослідження термінології наявних механізмів захисту права на свободу совісті та віросповідання як на міжнародному, так і національному рівнях, задля підвищення обізнаності громадян. Розроблення порад, які підвищать краще розуміння потреб і проблем різних релігійних груп, допоможуть знаходити компромісні рішення і забезпечувати стабільність та розвиток суспільства в цілому, підтримувати освітні та просвітницькі програми, які б підвищували рівень релігійної толерантності та взаєморозуміння серед громадян. Дослідження виконано в рамках наукового проєкту «Механізми суспільної солідаризації в умовах криз: історичний досвід та виклики сучасності» (0123U101851) за підтримки Міністерства освіти і науки України.

The relevance of the research topic lies in the problem of protecting freedom of conscience and religion in the modern international legal aspect, as it concerns every person. In general, several reasons can be identified: firstly, human rights and fundamental freedoms are the main value and priority of the modern world; secondly, the protection of religious rights and freedoms is important not only at the individual level, but also in the context of international relations, democracy and tolerance of society. And by studying international and national protection mechanisms, it is possible to determine the effectiveness of their application, and actually their impact on real situations. The purpose of the work is to carry out a comprehensive analysis and research of international and national mechanisms for ensuring freedom of conscience and religion, to identify the main challenges and problems in this area, as well as to develop recommendations for improving legal regulation for the effective protection of this fundamental right. The object of the study is the relations arising in the field of protection of the right to freedom of conscience and religion at the national, European and universal level. The subject of the study is international and national mechanisms for the protection of freedom of conscience and religion. The main results of the work were the study of the terminology of the available mechanisms for the protection of the right to freedom of conscience and religion at both the international and national levels, in order to increase the awareness of citizens. The development of advice that will increase a better understanding of the needs and problems of various religious groups will help to find compromise solutions and ensure the stability and development of society as a whole, support educational and educational programs that would increase the level of religious tolerance and mutual understanding among citizens.
