Доступ до правосуддя людей з психічними розладами: європейські стандарти та національна практика

Abstract

У роботі визначено та опрацьовано ключові міжнародно-правові документи у сфері захисту прав осіб з психічними розладами (Конвенція ООН про права осіб з інвалідністю, Європейська конвенція з прав людини, практика ЄСПЛ), а також виявлені правові прогалини і структурні бар’єри у національній системі доступу до правосуддя. Завдяки дослідженню було доведено, що українське законодавство потребує глибшої гармонізації з міжнародними стандартами, зокрема через впровадження моделі підтриманого прийняття рішень, розвиток інституцій правової допомоги, удосконалення процедур визнання дієздатності, адаптацію судового процесу до потреб осіб з психічними розладами, а також подолання соціальної стигматизації. Запропоновано рекомендації щодо законодавчих та інституційних змін, спрямованих на ефективну реалізацію права на доступ до правосуддя.

The main results of the study include the identification and analysis of key international legal documents in the field of protecting the rights of people with mental disorders (such as the UN Convention on the Rights of Persons with Disabilities, the European Convention on Human Rights, and the case law of the European Court of Human Rights), as well as the identification of legal gaps and structural barriers in Ukraine's national justice system. The study demonstrates the need to harmonize Ukrainian legislation with international standards, including through the introduction of supported decision-making models, the development of legal aid institutions, the improvement of procedures for recognizing legal capacity, the adaptation of court proceedings to the needs of persons with mental disorders, and the overcoming of social stigma. The thesis offers recommendations for legislative and institutional changes aimed at ensuring effective access to justice.
