Abstract

Актуальність теми дослідження пов’язана з великою кількістю мігрантів міграційних процесів, зокрема пов’язаних з біженцями. Війни, екологічні катастрофи, політичні переслідування, все це спонукає людей покидати свої країни в пошуках кращого життя. Багато біженців лишається в країнах тереторіально наближених до їхньої, але багато долають довгий шлях для того щоб потрапити в Європейські країни, через їх економічну стабільність та один з найкращих соціальний захист у світі. В роботі проведено аналіз публікацій, досліджень, міжнародно-правових актів на глобальному та регіональному рівнях зокрема у рамках Європейського союзу, у рамках Ради Європи, рішень Європейського суду з прав людини. Також було використано метод дослідження щодо міграційних процесів та криз. Мета роботи дослідження міжнародно - правових стандартів соціального захисту та інтеграції біженців. Об’єктом дослідження є міжнародний механізм захисту прав біженців, в тому числі щодо їх соціального захисту та інтеграції. Предмет дослідження становлять міжнародно-правові стандарти щодо соціального захисту та інтеграції біженців. Основними результатами роботи стало висвітлення правового статусу біженців на глобальному та регіональному рівнях, соціального захисту та інтеграції біженців на регіональному (ЄС, РЄ та інші) та національному (Німеччина) рівнях. Та аналіз судових рішень Європейського суду з прав людини, щодо соціального захисту біженців.The relevance of the research topic is associated with a large number of migrants and migration processes, in particular those related to refugees. Wars, environmental disasters, political persecution because of race, religion, political views and beliefs, all this encourages people to leave their countries in search of a better life. Many refugees remain in countries territorially close to theirs, but many overcome a long way to get to European countries, due to their economic stability and one of the best social protection in the world. A model for building a high-quality system of social protection and security for citizens is the social model of the European Union, which is characterized by a high level of social security, is based on the principles of respect for human dignity, social justice and security, and the prohibition of discrimination in the field of social protection. The article presents the system of social protection for refugees using the example of an EU member state - Germany. The paper analyzes publications, research, international legal acts at the global and regional levels, in particular within the framework of the European Union, within the framework of the Council of Europe, decisions of the European Court of Human Rights. An analysis was conducted of organizations that regulate migration processes, especially those related to the mixing, placement, and assistance of refugees. Germany's experience in receiving, accommodating, and providing social protection to migrants and refugees is highlighted.The research method on migration processes and crises was also used. The purpose of the work is to study international legal standards for social protection and integration of refugees. The object of the research is the international mechanism for protecting the rights of refugees, including their social protection and integration. The subject of the research is the international legal standards for the social protection and the refugee’s integration. The research methods are the analysis of publications, studies, international legal acts at the global and regional levels, in particular within the framework of the European Union, within the framework of the Council of Europe, decisions of the European Court of Human Rights. The research method on migration processes and crises was also used. The main results were the fulfillment of the tasks set, namely: highlighting the norms in international legal documents at the global and regional levels, on the issue of social protection and integration of refugees, international organizations involved in regulating the issues of social protection and integration of refugees, highlighting the standards of the Council of Europe and the European Union, on the social protection and integration of refugees, Germany's experience in ensuring rights in the field of social protection and integration of refugees. Also highlighted was the coverage of the refugee’s legal status at the global and regional levels, social protection and integration of refugees at the regional (European Union, Council of Europe and others) and national (Germany) levels, and analysis of court decisions of the European Court of Human Rights, on the social protection of refugees.
