Європейські правові стандарти використання штучного інтелекту

Abstract

Актуальність обраної теми зумовлена необхідністю осмислення та правового аналізу міжнародних стандартів у сфері ШІ, а також оцінки можливостей їх імплементації у національні правові системи. Особливої уваги потребує з’ясування, наскільки сучасне європейське правове поле спроможне гарантувати повагу до основоположних прав і свобод особи в умовах динамічного технологічного прогресу. В роботі проведено важливий аналіз норм як міжнародного, так і національного права, а також судової практики, що стосується захисту прав людини у сфері використання технологій штучного інтелекту (ШІ). Це питання є надзвичайно актуальним, оскільки технології ШІ швидко розвиваються і впливають на різні аспекти життя, включаючи права людини. Мета роботи - комплексне дослідження європейських правових стандартів використання штучного інтелекту. Основними результатами роботи стало: з’ясування змісту та значення європейських правових стандартів у сфері штучного інтелекту, аналіз Європейського акту про штучний інтелект (AI Act) як першого комплексного нормативного документа в цій сфері, визначення ключових викликів та бар’єрів для його імплементації у національне законодавство України, а також обґрунтування необхідності формування відповідної правової, інституційної та технічної бази для ефективного впровадження європейських підходів до регулювання ШІ.

The relevance of this topic is stipulated by the need to comprehend and legally analyze international standards in the field of AI, as well as to assess the possibilities of their implementation in national legal systems. Particular attention should be paid to the extent to which the current European legal framework is able to guarantee respect for the fundamental rights and freedoms of individuals in the context of dynamic technological progress. This work provides an important analysis of the norms of both international and national law, as well as case law relating to the protection of human rights in the field of artificial intelligence (AI) technologies. This issue is extremely relevant, as AI technologies are rapidly developing and affecting various aspects of life, including human rights. The purpose of this paper is to conduct a comprehensive study of European legal standards for the use of artificial intelligence. The main results of the work were: clarification of the content and significance of European legal standards in the field of artificial intelligence, analysis of the European Artificial Intelligence Act (AI Act) as the first comprehensive regulatory document in this area, identification of key challenges and barriers to its implementation in the national legislation of Ukraine, as well as justification of the need to form an appropriate legal, institutional and technical framework for the effective implementation of European approaches to AI regulation.
