Військові суди

Abstract

У статті проаналізовано доцільність запровадження принципів формування військових судів і їх місце в системах військової юстиції та судів загальної юрисдикції. Головний фактор ефективної діяльності Збройних Сил України - налагоджена структура військової юстиції. До судової системи загальних судів включено і військові суди регіонів, Військово-Морських сил та гарнізонів поряд із судами, що створюються за адміністративно-територіальним принципом. Тому, як частка єдиної системи загальних судів, військові суди являють собою підсистему, що пристосована до організаційної структури Збройних сил України. Військові суди до їх ліквідації у 2010 році розглядали усі кримінальні справи щодо військовослужбовців або за їх участю, а також адміністративні справи у спорах військовослужбовців з командуванням, стояли на сторожі дисципліни та правопорядку у військах. Реформою 2010 року були ліквідовані військові суди — тепер справи, що мали б розглядатися гарнізонними військовими судами розглядаються судами загальної юрисдикції першої інстанції, а справи, що мали б розглядатися у апеляційних військових судах розглядаються у апеляційних судах загальної юрисдикції. Активно ведеться дискусія про необхідність повернення військових судів в Україні. Водночас для того, щоб вони не тільки ефективно працювали, а й не порушували права громадян, необхідно вивчити практику Європейського суду з прав людини. Слід врахувати й особливості роботи в умовах бойових дій, а, отже, підвищеного навантаження.

In the article it was analyzed the practicability of implementation of principles of formation of military courts and its place in the systems of military justice and courts of general jurisdiction. The main factor of meaningful activity of Armed Forces of Ukraine is the fine-tune structure of the military justice. To the court system of general jurisdiction is included also military regional courts, courts of Naval Forces and garrisons on the same basis as courts which are created by administrative-territorial principle. So, as the share of a single system of general courts, military courts are the subsystem that is adapted to the organizational structure of the Armed Forces of Ukraine. Military courts before its liquidation in 2010 entertained all criminal cases in regard to military or involving them and also administrative cases in disputes of military and command standed guard over discipline and military order. By the reform in 2010 military courts were liquidated – now cases which should be considered at the appellate military courts are considered in the appellate courts of general jurisdiction. It is actively discussed about the necessity of returning military courts in Ukraine. However, in order they don’t only work efficiently, but do not violate the rights of citizens, it is necessary to research the practice of the European Court of Human Rights. It should be taken into account also peculiarities of work in the conditions of shooting war and consequently high load.
