Договори в процесі розлучення: окремі теоретичні та практичні аспекти

Abstract

У статті розглядаються проблеми договірного регулювання відносин подружжя в процесі розлучення, визначення змісту договорів про надання утримання та про виховання дітей в порядку ст. 109 СК України, виявлення договірних конструкцій для врегулювання інших спірних питань, що виникають в процесі розлучення подружжя, а саме: поділ майна подружжя, виділ частки зі спільного майна подружжя, користування спільним майном, забезпечення житлових інтересів дітей тощо.

The article considers the problems of contractual regulation of marital relations in the process of divorce, determining the content of agreements on maintenance and upbringing of children in accordance with Art. 109 of the IC of Ukraine, identification of contractual constructions for settlement of other disputable issues arising in the process of divorce, namely: division of property of spouses, allocation of shares from joint property of spouses, use of joint property, ensuring housing interests of children, etc.
