Теоретико-правовий аналіз принципів права як інтегруючого елементу правової системи

Abstract

Стаття присвячена вивченню принципів права як інтегративного елементу правової системи. Автором розглянуто основі інтеграційні зв’язки із різними компонентами правової системи, зокрема інтеграції принципів права із ідеологічними компонентами правової системи, що у подальшому впливає на формування та розвиток доктринальної складової правової системи. Розглянуто зовнішню спрямованість інтеграційного впливу принципів права, що виявляється опосередковано у взаємодії правової системи із соціальною системою (суспільство) завдяки інтегративним властивостям принципів права.

The article is devoted to the study of the principles of law as an integrative element of the legal system. The author considers the basis of integration relations with various components of the legal system, in particular the integration of legal principles with ideological components of the legal system, which further affects the formation and development of the doctrinal component of the legal system. The external orientation of the integration influence of the principles of law, which is manifested indirectly in the interaction of the legal system with the social system (society) due to the integrative properties of the principles of law, is considered.
