Abstract У статті розглянуто справу «Застосування Міжнародної конвенції про боротьбу з фінансуванням тероризму і Міжнародної конвенції з ліквідації всіх форм расової дискримінації (Україна проти Російської Федерації)», ініційовану поданою до Міжнародного суду ООН 16 січня 2017 року Заявою України. 8 листопада 2019 року, як наслідок висунутих Російською Федерацією 12 вересня 2018 року попередніх заперечень юрисдикції Суду та прийнятності позову України, Міжнародний суд ООН виніс Рішення щодо розгляду попередніх заперечень Російської Федерації на користь України. У Рішенні Суд визначив предмет спору між сторонами і встановив свою юрисдикцію відповідно до п. 1 ст. 24 Міжнародної конвенції про боротьбу з фінансуванням тероризму і ст. 22 Міжнародної конвенції з ліквідації всіх форм расової дискримінації. У статті приділено окрему увагу як аналізу висновків МС ООН щодо визначення такого предмету (тобто, тих спірних питань, які стануть основою розгляду даної справи по суті), так і вивченню юрисдикції Суду у цій справі
The article examines the case "Application of the International Convention for the Suppression of the Financing of Terrorism and the International Convention on the Elimination of All Forms of Racial Discrimination (Ukraine v. Russia)", initiated by the Statement of Ukraine submitted to the UN International Court of Justice on January 16, 2017. On November 8, 2019, as a result of preliminary objections raised by the Russian Federation on September 12, 2018, the jurisdiction of the Court and the admissibility of Ukraine's claim, the UN International Court of Justice ruled on preliminary objections of the Russian Federation in favor of Ukraine. In the Decision, the Court determined the subject matter of the dispute between the parties and established its jurisdiction in accordance with paragraph 1 of Art. 24 of the International Convention for the Suppression of the Financing of Terrorism and Art. 22 of the International Convention on the Elimination of All Forms of Racial Discrimination. The article pays special attention both to the analysis of the conclusions of the UN Security Council on the definition of such a subject (ie, those controversial issues that will form the basis of this case on the merits) and to the study of the Court's jurisdiction in this case.
